Welcome to 61s.ai, operated by 61S Studio ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our AI-powered video creation platform (the "Service"). Please read these Terms carefully before using the Service.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or legal guardian's consent. By using the Service, you represent and warrant that you meet these requirements.

2. Account Registration

• You must provide accurate, current, and complete information during registration.

• You are responsible for maintaining the confidentiality of your account credentials.

• You are responsible for all activities that occur under your account.

• You must notify us immediately of any unauthorized use of your account.

• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions and Payments

3.1 Plans and Pricing

We offer free and paid subscription plans. Paid plans provide additional features, higher usage limits, and expanded rights to generated content. Current pricing is available on our pricing page.

3.2 Billing

• Paid subscriptions are billed on a recurring basis (monthly or annually) as selected at the time of purchase.

• Payment is processed through our third-party payment processors, which may include Stripe, Creem, and other providers. By subscribing, you agree to the applicable payment processor's terms of service.

• You authorize us to charge your payment method on each billing cycle.

3.3 Credits

• Credits may be purchased separately to supplement your plan's usage allowance.

• Credits are non-transferable and have no cash value.

• Unused credits do not expire unless your account is terminated.

3.4 Refunds

First-time subscribers may request a refund within 7 days of their initial payment, subject to deduction for consumed credits. Credit top-up purchases may be refunded within 24 hours if unused or partially used. All other purchases are final. Please refer to our Refund Policy for complete details.

3.5 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. No prorated refunds will be issued for cancellations outside the refund window.

4. User Content and Intellectual Property

4.1 Your Content

"User Content" refers to all content you create, upload, or generate using the Service, including scripts, storyboards, prompts, images, and videos.

4.2 Ownership by Tier

• Free Users: Content generated under a free plan is provided for personal, non-commercial use only. You do not retain exclusive intellectual property rights to content generated under the free tier.

• Paid Users (and above): You retain ownership of the intellectual property rights in content generated under a paid plan, subject to the licenses granted below.

4.3 License to Us

By making any content public on the platform, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, reproduce, and promote that content in connection with operating and marketing the Service. This license continues even if you later make the content private, to the extent the content has already been distributed.

For private (non-public) content, we only access it as necessary to provide the Service (e.g., AI processing, storage, rendering).

4.4 Our Intellectual Property

The Service, including its design, features, code, and branding, is owned by 61S Studio and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

5. Acceptable Use

You agree to comply with our Acceptable Use Policy. You may not:

• Use the Service to generate illegal, harmful, or abusive content

• Attempt to reverse-engineer, decompile, or extract the source code of the Service

• Use automated means to access the Service without our prior written consent

• Interfere with or disrupt the Service or its infrastructure

• Impersonate any person or entity

• Violate any applicable laws or regulations

6. AI-Generated Content Disclaimer

The Service uses artificial intelligence to generate content. You acknowledge that:

• AI-generated content may contain errors, inaccuracies, or unintended outputs

• You are solely responsible for reviewing and verifying all AI-generated content before use

• We do not guarantee that AI-generated content is free from third-party intellectual property claims

• You assume all risks associated with the use or distribution of AI-generated content

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 61S STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Indemnification

You agree to indemnify, defend, and hold harmless 61S Studio, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

• We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice.

• Upon termination, your right to use the Service ceases immediately.

• Provisions that by their nature should survive termination will survive (including ownership, indemnification, limitation of liability, and dispute resolution).

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

11.2 Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall take place in the State of Delaware.

11.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in a class action, class arbitration, or representative proceeding.

12. Modifications

We may update these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Your continued use after changes constitutes acceptance.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
